A window cleaner was injured when he fell from the building he was working on. To do the job, he had to balance on a small windowsill only 6" wide. His employers had failed to provide him with the necessary equipment to keep one of the windows closed and he had no means of holding onto the building so he fell. It was found that the employer was in breach of their duty of care.
This case highlights that in many instances Regulation issued by the Government imposes strict duties on Employers.
A postman was thrown over the handlebars of his post office bicycle when the stirrup part of the brake failed and became lodged in the front wheel. This case went to Court and it was held that Regulation 5 of the Provision & Use of Work Equipment Regulations imposed an absolute duty on the employer. The employer was held liable even though the brake failure was due to a latent defect that could not have been discovered by the employer on routine inspection.
